Not surprisingly, SCOTUS was unanimous in Tyler v. Hennepin County. Here, Hennepin Co. in MN seized an elderly woman’s home over unpaid taxes, sold it, and kept profits far exceeding her tax debt. Justice Roberts said that the 5th Amendment was the only needed context. However, Justices Gorsuch and Jackson made explicit their shared opinion on the case and the 8th Amendment about excess fines.
