This ruling went further than a previous court: the Federal Government cannot require proof of citizenship and AG Bondi cannot take acction against states to decide to count mail-in ballots after election day. 13 states currently honor this practice, and the judge ruled that they have standing to sue.
Novel cases of voter disenfranchisement were mentioned:
- Residents of Maine may have Canadian birth Certificates and no passport
- Pueblo citizens in rural AZ have few personal documents
- Citizenship docs are expensive
- The states would carry the financial burden to revamp the procedures
