On July 24, SCOTUS blocked the appeals court decision—a 6 to 3 decision—meaning that individuals and civil rights groups retain their right to sue for racial discrimination under Section 2 of the Voting Rights Act.

The case contests the 2021 ND legislative maps, which underwent redrawing in 2023. The Native American plaintiffs—two tribes and three tribal individuals—won court approval to place both tribal communities in the same 2023 district.
